City cracks down on appeal continuances

This past year, when some people appealed Planning Commission decisions to the City Council, they requested too many continuances, according to the City Council and city staff.

The city's policy has always been to grant an appellant's first request for a continuance, as long as the time period is reasonable, and to waive the fee of $250. On Jan. 25, the council decided to allow appellants only one continuance, and if the appellants are not applicants, their continuances will be only until the next regular Council meeting following their scheduled public hearing.

From now on, continuances for appellants who are also applicants could be granted for up to 30 days. All subsequent continuances could be approved only by the City Council and would require payment of the $250 processing fee.

Winery hearings to take place Mar. 2

Public hearings regarding the Mountain Winery's use permit and architectural and site approval are now scheduled to take place Mar. 2, before the county planning commission. The Feb. 10 hearing that the commission had earlier set, has been cancelled.

The Mar. 2 hearing will take place in the county board chambers in the County Building at 70 West Hedding Street in San Jose. The time is yet to be determined.
