    Council to consider new city law for construction

    On Oct. 18, Saratoga city staff will present a draft ordinance to the city council concerning further limitation on the days and hours that construction is permitted in the city.

    Saratoga already has an ordinance restricting construction for all residential projects to between the hours of 7:30 a.m. and 6 p.m. every day. However, according to Community Development Director James Walgren, when the city approves large residential subdivisions, it usually includes a restriction on weekend construction.

    Construction for commercial projects--retail, office, personal service or institutional buildings--is allowed during the same hours but is prohibited on Saturdays and Sundays.

    The ordinance also prohibits all single noise sources from surpassing a certain decibel level. If residents violate any part of the ordinance, neighbors can report them to the Santa Clara County Sheriff's Office.

    The draft ordinance that will be considered by the council on Oct. 18, could either prohibit residential construction on Sundays and possibly shortening the allowable hours for construction on Saturdays, or it could prohibit all weekend construction for projects requiring a city permit. In this case, homeowner improvement projects that do not require a permit from the city would be exempt.

    The latter option would most impact homeowners trying to build a new home or addition, according to Walgren, who also notes that weekends are typically the time that a homeowner may make small home and garden improvements that do not require a permit but that may constitute construction.

    A letter from an Oak Street resident to the council, asking the city to only allow construction--even residential--on weekdays, spurred Mayor Stan Bogosian to place the issue on the Sept. 6 council agenda.
