Saratoga Drug Store can exercise its lease option

Santa Clara County Superior Court Judge Conrad L. Rushing has ruled that Ray Rossi can exercise his option to renew his lease on the property that houses the Saratoga Drug Store.

Rushing heard closing arguments from attorneys for building owner Marcelle Bloxham and store owner Ray Rossi during a three-day trial starting Dec. 4. Rushing notified attorneys for both parties on Dec. 15.

The trial caps an almost nine-month squabble between Rossi and Bloxham, which began earlier this year when Rossi, who has owned the store for nearly 20 years, tried to exercise what he believed to be an option on his lease that would allow the store to continue at 14413 Big Basin Way for another 10 years. His lease for the 2,200-square-foot storefront was due to expire in June.

Ron Rossi, attorney for Ray Rossi (no relation) told the Saratoga News the judge ruled in his client's favor on all counts, including a limit on annual rent increases of no more than 2.5 percent. "The judge found all their evidence not to be credible," the attorney said.

Neither party was available for comment at press time.
