Hemmes will serve sentence, then register as sex offender

A Los Gatos resident and assistant soccer coach is on hook for life as a criminal sex offender.

In court on Aug. 5, Jason Allen Hemmes, 45, pled "no contest," which is the equivalent of guilty, to three felony counts of lewd conduct with a minor and one misdemeanor for child molestation, according to Santa Clara County Deputy District Attorney Rob Baker.

Hemmes was arrested in March after having a relationship with a 15-year-old girl on his team in the Los Gatos United Soccer League. A Santa Clara sheriff's sergeant patrolling the Lexington Reservoir area came across Hemmes and the 15-year-old parked in a white Ford Explorer, Baker said. Hemmes initially told the sergeant the female was 35, but when the sergeant asked the girl for her age, she said she was 15.

Baker said Hemmes had been involved in an ongoing and consensual relationship with the female since November 2002, frequently picking her up after school and sending her inappropriate emails.

Baker said the charges related to this first victim led to a second victim, who knew Hemmes through their mutual affiliation with Holy Cross Lutheran Church in Los Gatos. The female victim, who was under the age of 14, reported that Hemmes had fondled her on a church camping trip without using force or violence, Baker said.

Hemmes was again taken into custody and released on bail in April. He was ordered not to contact either of the victims while the case was under investigation. But the father of the 15-year-old found that Hemmes had been chatting online with his daughter, violating the terms of his release, Baker said, and Hemmes was taken back into custody to await his court date.

Hemmes, who was married and has two daughters, will be officially sentenced on Aug. 28 to one year in state prison. Baker said the six months Hemmes has served already are waived, so he will actually serve a total of 11/2 years in prison. Hemmes will be taken to San Quentin State Prison and then placed elsewhere within the state-prison system.

Once he is released, Hemmes will be on parole for three to five years and must register as a lifetime sex offender, said Baker. Prior to the case, Hemmes had no criminal record. Hemmes will also have to pay restitution to the victims for counseling and other related services.

"He's on the hook," Baker said. "He showed no regard during trial for his family or the victims' families. He violated a position of trust," Baker said.

Baker said he was pleased with the sentence, but advised that even though the case is closed, victims can still come forward.

"Women out there shouldn't remain silent just because the case is over," he said.
