John Lietzke, a 26-year old Saratoga resident, was arrested on charges stemming from an alleged "date rape" committed in Mountain View on Jan 30. San Jose and Mountain View police arrested Lietzke on Feb. 2 at a San Jose Sharks game at the HP Pavilion in San Jose, according to a report released by the Mountain View Police Department. Lietzke was taken into custody without incident.
Steve Fein, of the Santa Clara County District Attorney's office, said Lietzke is being held without bail and has been charged with one count of kidnapping with the intent to commit rape and one count of rape of an intoxicated person. Lietzke will enter a plea on Feb. 28. Fein said if convicted on both charges, Lietzke faces a maximum sentence of life in prison plus eight years.
According to a police report, on the evening of Jan. 30, an unaccompanied adult female was at a drinking establishment on Castro Street in downtown Mountain View. She briefly left her drink unattended before returning and consuming it. Sometime later she awoke to find herself being assaulted in a parked vehicle. She was able to free herself, flee the area and seek treatment at a hospital.
Lietzke was later identified as the alleged assailant.
According to the Drug Enforcement Agency's website, "date rape drugs" render a victim incapable of resisting sexual advances. Sexual assaults facilitated by these types of drugs can be difficult to prosecute or recognize because victims may not be aware that they ingested a drug. Date rape drugs such as gamma-hydroxybutyrate (GHB) and its analogues, are invisible when dissolved in water, and are odorless. The drugs are somewhat salty tasting, but are indiscernible when dissolved in beverages such as sodas, liquor or beer. Due to memory problems induced by these drugs, the victim may not be aware of the attack until eight to 12 hours after it occurred. The drugs are metabolized quickly, so there may be little physical evidence to support the claim that the drugs were used to facilitate an assault. Memory impairment caused by the drugs can also eliminate evidence of the attack.
Capt. John Hirokawa said the Santa Clara County Sheriff's Department had no previous contact with Lietzke and was not involved in the investigation or arrest.
