A Sunnyvale Public Safety Officer faces driving under the influence charges after being stopped late at night on Sept. 21 while allegedly weaving through traffic on Highway 85 south of Camden Avenue.
Assistant District Attorney Karyn Sinunu said a California Highway Patrol officer stopped Lt. Douglas Michael Sims' black GMC truck and attempted to test his sobriety--but Sims refused to submit to the test.
The officer reportedly found eight firearms inside the vehicle and a dead boar in the bed of the truck.
According to Sinunu, Sims tried to get the officer to let him go, at one point allegedly saying "We're on the same team," and trying to let him call for a ride.
Sims was arrested on charges of driving under the influence and was cited and released. Public Affairs Officer Les Bishop, from the California Highway Patrol, said Sims was not taken into custody because putting a peace officer in a cell with other inmates could incite violence.
According to the Sunnyvale Department of Public Safety, Sims is a fire station captain and a member of the city's award-winning SWAT team.
Sinunu said there is no arraignment date set for the officer.
