Battlefield: The San Jose Unified School District began construction on the John Muir Middle School field on Jan. 17.
Community won't stop CAIRing about Muir
It's not a done deal yet.
That's the message CAIR (Community Action In Robertsville) President Jim Chase wants to get across, in response to a Superior Court judge's decision to allow San Jose Unified School District to move Broadway High to the John Muir Middle School campus.
"There's really no change in our strategy," Chase said. "The confusion was based on our loss of our temporary restraining order so people misinterpret that as the end of litigation."

A Sporting Chance: The district hopes to have students from Broadway High moved into portables on the Muir campus by spring.
CAIR last week filed an appeal to reverse the court's decision allowing construction to begin at the Muir site. There is no date set for the appeal hearing. The community group also held a meeting to let neighbors know it doesn't view the recent court ruling as the end of the Broadway/Muir discussion.
The neighborhood organization has maintained its two-pronged attack with its main lawsuit, challenging the district's site-selection process, and the temporary restraining order, asking SJUSD to stop construction at the middle school until the lawsuit has been resolved.
CAIR leadership remains optimistic about its legal battles, despite the current setback. "The judge gave [the district] their right to go on, but if we win the lawsuit, they will have to choose a new site and repair any changes made to Muir School. It's all part of the legal process," Chase said.
