    13-year-old boy is stable following a hit-and-run

Police are holding two men who allegedly were in the car, which was abandoned

A 13-year-old Willow Glen boy is in critical but stable condition after being struck by a car whose two occupants fled the scene.

The injured boy, an eighth grader at Willow Glen Middle School, was riding his bike north on Cherry Avenue at 7:45 a.m. on Tuesday, March 9, when he was struck by a car heading eastbound on Curtner Avenue, San Jose Police officer Rubens Dalaison said.

Two men were arrested four hours later after abandoning the vehicle. Police located them at their place of employment.

The boy was admitted to Santa Clara Valley Medical Center with head injuries and a broken leg, ankle and elbow.

The alleged driver, Campbell resident Octavio Miranda Pastrana, 23, was booked at Santa Clara County Jail on suspicion of felony hit-and-run. If convicted, he could face imprisonment for up to one year, or a fine of up to $10,000, or a combination of the two, police said.

The passenger, Jorge Miranda Pastrana, 33, the brother-in-law of the driver, was booked on a no-bail warrant.

The details of the accident are still under investigation.

It's scary, say some neighborhood parents, living at such a busy intersection located only one block from the school.

"It's a mess in the mornings," says Cherry Avenue resident Michelle Garcia. Garcia's son is a sixth grader at Willow Glen Middle School.

"I'm surprised that they don't have a crossing guard there. Maybe it's the fact that these aren't elementary school children so they don't put a crossing guard there, but they should. I have a sixth grader and I drive him to school and pick him up. It's far too busy of an intersection."
