Monster home ordinance hearing is rescheduled
The so-called "monster-house" ordinance--Frank Fiscalini's proposed design review law, which was scheduled for Planning Commission review on June 23, has been postponed until Wednesday, July 14.
The proposal--which would require city planners to review plans for new homes and rebuilds--was initially scheduled to go before the commission on May 26. The date has been pushed back so that city planners can analyze the additional work load the ordinance will bring to the department, senior planner Jean Hamilton said. During the last month, planners have been reviewing building permits to determine how many would trigger a design review under the new law, Hamilton said.
After its approval by the Planning Commission--give or take any changes--the proposal will be passed on to City Council.
The council probably won't act on the proposal until August at the earliest, after its recess in July, according to officials.
Homeowners now wishing to add on to their houses have free rein over any additions. Under the proposed ordinance, however, a site development permit would be required for the construction of all single-family homes. Planners would also review plans for some remodels and additions.
Information on the proposed law is available online at www.ci.san-jose.ca.us/planing/sjplan/.
